Refund policy

This information on the right of withdrawal applies to consumers and to every contract you conclude with us on ngmapp.com: licences for the NGM Tuning App (digital content), the NGM OBD2 adapter (goods) and the replacement control unit (goods, see section 4).

1. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is

a) in the case of a contract for the supply of digital content which is not supplied on a tangible medium (e.g. a licence for the NGM Tuning App): fourteen days from the day of the conclusion of the contract.

b) in the case of a sales contract for goods (e.g. the NGM OBD2 adapter): fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.

Exercising the right of withdrawal

To exercise the right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.

You can also exercise your right of withdrawal online using the “Withdraw from contract” button in the footer of our website (ngmapp.com/#widerrufsbutton). If you use this online function, we will send you without delay, on a durable medium (e.g. by email), an acknowledgement of receipt stating the content of your withdrawal and the date and time it was received.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

2. Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

For sales contracts for goods the following also applies: We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us (address above) without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

3. Early expiry of the right of withdrawal for licences (digital content)

In the case of a contract for the supply of digital content which is not supplied on a tangible medium (e.g. a licence for the NGM Tuning App), your right of withdrawal expires early under section 356(6) of the German Civil Code (BGB) once we have begun performance of the contract, provided that beforehand you

  • expressly consented to us beginning performance of the contract before the withdrawal period has expired,
  • acknowledged that you lose your right of withdrawal once performance begins, and
  • received from us a confirmation of the contract on a durable medium (e.g. by email) which records this consent and acknowledgement.

You give this consent and acknowledgement in the cart by ticking a separate box that is not pre-ticked. We begin performance of the contract when you activate the licence on your vehicle in the app. At that moment the licence is permanently bound to the vehicle identification number (VIN) of your car and our service has been delivered in full. Your right of withdrawal for that licence expires on activation.

As long as you have not activated the licence on a vehicle, you can withdraw from the contract within the withdrawal period of fourteen days from the conclusion of the contract as described in section 1. The licence being available in your account or the app being installed does not end your right of withdrawal.

4. No right of withdrawal for the replacement control unit

We program the replacement control unit for facelift models to the vehicle identification number (VIN) of your car before shipping. It is therefore made to your individual specification and clearly personalised. There is no right of withdrawal for this sales contract under section 312g(2) no. 1 BGB. We point this out to you before you order. Your statutory rights in the event of defects are not affected.

5. Notes for customers in Austria, Switzerland and the United Kingdom

Austria: The right of withdrawal described here corresponds to the right of Rücktritt under the Fern- und Auswärtsgeschäfte-Gesetz (FAGG). Where this notice says “withdrawal”, it means your Rücktritt from the contract. Period, exercise and effects are the same.

Switzerland: Swiss law does not provide a statutory right of withdrawal for online purchases. If you live in Switzerland, we voluntarily grant you the same right of withdrawal as described in this notice, including the rules on early expiry for licences (section 3) and on the replacement control unit (section 4).

United Kingdom: If you are a consumer living in the United Kingdom, you have the right to cancel the contract within fourteen days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Period, exercise and effects correspond to this notice. The same rule on early expiry applies to licences: if you have expressly requested supply before the end of the cancellation period and acknowledged that you thereby lose your right to cancel, the right ends when the licence is activated on your vehicle (Regulation 37).
